Can a servicer reject a reinstatement payment?
Generally, no. Under standard mortgage contracts and state foreclosure laws, homeowners have the absolute right to reinstate their mortgage loan at any time before the foreclosure sale occurs (or up to 5 days before the sale under standard Fannie Mae guidelines).
Why are property inspections charged to my account?
Most mortgage notes contain a clause permitting the lender to protect their security interest by performing drive-by physical inspections of the property once the account goes past due. These typically cost $15 to $30 and are performed monthly.
How do I request a formal reinstatement quote?
Call your servicer's loss mitigation or customer assistance department and request a "written reinstatement quote". Specify the date you plan to pay (typically valid for 15 or 30 days) to lock in the quote figures under federal rules.
What happens if a servicer overcharges fees?
Under the CFPB's Real Estate Settlement Procedures Act (RESPA), you can file a formal "Notice of Error" (NOE) identifying the overcharge. The servicer must acknowledge receipt within 5 business days and resolve the error within 30 business days.
